License for tour operator activities

Lion's Mark Law Company provides the services of obtaining the License for tour operator activities.

The main document, which regulates the legal relations in the field of implementation and organization of tourism in Ukraine is the Law of Ukraine "On tourism" of 9/15/1995 No. 324/95-VR. According to the Law, business entities have no right to use the words "Tour operator"  in its name if they have no license for tour operator activities.

In the licensing conditions the Tour operators are defined as the legal entities established according to the current legislation of Ukraine whose sole purpose is provision and organization of the tourism product, provision and implementation of tourist services, intermediary activity in provision of related and specific services and who obtained the license for tour operator activities in the prescribed manner.

Besides, the licensing conditions provide for a list of requirements, which should be met by the aplicants for a license and the licensees performing their activities as a tour operator:

1. For staff:
   The head of a Tour operator company, its branch or other subdivisions of tour operator must have:
   
   • a university degree in the field of tourism; or
     
   • a university degree and at least a 3-year experience in the field of tourism.
     
2. Tour operator shall have a relevant financial quarantee:
   For compensation of liability for any damage that may be caused to a tourist in the event of circumstances of a licensee's insolvency, Tour operator is required to provide a proof of financial support of his responsibility, a bank or other lending institution guarantee to the tourist in the manner prescribed by law.
   
   Please note, that the minimum amount of financial guarantee for tour operator activities is not less than EUR 20 000.
   

For obtaining the Tour Operator License, it is necessary to submit the following documents:

1. Standard application form;
   
2. List of documents;
   
3. Extract from USR;
   
4. Title / Lease contract for office premises (a copy signed and sealed by the head);
   
5. A bank or other lending institution guarantee certificate with amount of coverage not less than EUR 20 000 (notarized copy);
   
6. An agreement with an insurance company for compulsory insurance (health and accident) of tourists (a copy signed and sealed by the head);
   
7. Power of Attorney to act on your behalf.

Services of obtaining the License for tour operator activities include:
